1. Agreement and eligibility
These Terms of Use form an agreement between you and KokoJDN, an independent developer based in Texas, United States, the operator and publisher of Homiary. By downloading, accessing, or using Homiary, you agree to these Terms and must review and acknowledge the Safety Notice. The Privacy Policy is a separate notice describing Homiary's information practices; it is not presented as consent to unrelated processing. If you do not agree to these Terms or cannot make the required Safety acknowledgement, do not use Homiary.
You must be at least 18 years old and legally able to enter this agreement. Homiary's initial availability is limited to users in the United States.
2. What Homiary provides
Homiary is a home-maintenance organization tool. It can help you record property information, organize maintenance and equipment records, view reminders, attach supporting local files, and understand general maintenance topics. Homiary is not a home inspection, emergency-monitoring, engineering, architectural, legal, insurance, financial, medical, trade, or contractor service.
Features may change, be corrected, be discontinued, or be unavailable. Current home records and attachments persist locally on the Android device until they are deleted, become unavailable at an external document provider, Homiary storage is cleared, or Homiary is uninstalled. Homiary does not currently provide cloud backup, synchronization, or cross-device restoration of home records. You are responsible for exporting and retaining any records you cannot afford to lose.
3. Safety and professional services
You must review and follow the Homiary Safety Notice. Homiary's reminders, dates, costs, lifespans, status indicators, and educational content are general estimates based only on available records. They do not inspect, diagnose, certify, or guarantee your property, equipment, code compliance, or safety.
Manufacturer instructions, product recalls, permits, applicable codes, utilities, emergency authorities, and appropriately qualified and insured professionals take priority over Homiary content. Do not perform work beyond your training, licensing, authorization, equipment, or physical ability. High-risk and emergency work requires the escalation described in the Safety Notice.
4. Accounts and security
You may use the Free device-only experience without connecting Google. If you connect an account, you are responsible for protecting access to it and for activity performed through it. Notify homiaryapp@gmail.com promptly if you believe the account is compromised.
Do not share credentials, impersonate another person, bypass access controls, interfere with Firebase or Google Play verification, manipulate entitlement state, reverse engineer protected service components except where law expressly permits, or use Homiary to harm another person or property.
5. Your records and lawful use
You retain ownership of information you enter into Homiary. You are responsible for its accuracy, lawfulness, and your right to use it. Do not enter unlawful content, malicious code, another person's confidential information without authorization, or material that infringes intellectual-property or privacy rights.
Home records are currently held on the device as described in the Privacy Policy and are not licensed to KokoJDN merely because you enter them. If future features require uploading content, updated terms will explain the limited permissions required to store, process, display, or transmit it.
6. Homiary Plus
If you purchase Homiary Plus, the separate Subscription Terms apply. Google Play controls checkout, localized price, taxes, payment processing, automatic renewal, cancellation, and applicable refund processing. A Google-connected Homiary account may be required to verify Plus access.
Payment does not turn Homiary guidance into professional advice, an inspection, a warranty, or a safety certification. Safety information and emergency escalation remain available without a paid plan.
7. Third-party services and links
Homiary depends on services provided by Google, including Firebase, Google sign-in, Google Play Integrity, Google Play Billing, and the Google Play services ML Kit document scanner. Your use of those services is also subject to Google's terms and policies. External applications, document providers, and links are provided for convenience; KokoJDN does not control them or guarantee their availability, content, security, or practices.
8. Homiary ownership
Homiary's software, branding, interface, original text, graphics, and other materials are owned by KokoJDN or its licensors and are protected by applicable law. Subject to these Terms, KokoJDN grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Homiary for lawful household-management purposes.
9. Suspension, deletion, and termination
You may stop using Homiary at any time. Account deletion, local data removal, and Google Play subscription cancellation are separate actions explained on the account-deletion page.
KokoJDN may restrict or terminate access when reasonably necessary to protect Homiary, users, service providers, or the public; respond to unlawful conduct; enforce these Terms; or comply with legal requirements. Where practical, we will provide notice and an opportunity to correct the issue.
10. Disclaimers
To the fullest extent permitted by law, Homiary is provided “as is” and “as available.” KokoJDN disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and results. KokoJDN does not warrant that Homiary will be uninterrupted, error-free, complete, current, or suitable for a particular property or task.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you. Nothing in these Terms limits a right that cannot lawfully be waived.
11. Limitation of liability
To the fullest extent permitted by law, KokoJDN will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost data, revenue, savings, or profits; or property damage, personal injury, or loss arising from reliance on a reminder, estimate, status, recommendation, omitted task, unavailable feature, or third-party service.
These limitations apply only to the extent permitted by applicable law and do not exclude liability that cannot legally be excluded or limited.
12. Governing law and disputes
Before filing a claim, you and KokoJDN agree to make a good-faith effort to resolve the issue by emailing homiaryapp@gmail.com with a description of the concern and requested resolution.
These Terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules. Any dispute not resolved informally may be brought in a state or federal court with jurisdiction in Texas. These Terms do not require mandatory arbitration and do not waive any right to bring an eligible claim in small-claims court.
13. Changes
KokoJDN may update these Terms when Homiary or applicable requirements change. The current version and effective date will be available at this URL. If a change is material, Homiary will provide additional notice or request renewed acceptance when required.
